they deserve the same legal rights. the obama administration would not defend that law. the house republicans appointed john clement. many of those cases are under appeal and they will surely decide one of those cases this spring host: is there one more likely than the other? guest: that is an inside baseball question. the problem that arose is that elena kagan was the solicitor general when some of those cases were beginning and she mentioned at her confirmation hearings that she had participated in discussions about one of the cases. i think what the court wants to try to do is find a case where she came later and had no involvement. you want nine justices. they don't want age. you could get a split in the would not decide anything. host: she would be one of the key votes to watch? guest: when it is a close vote, every vote is a key vote. in answer to your question, there are several cases and it is not a matter of a good or bad case. one of the deciding issues will be of justice kagan participated. when eight supreme court struck down an act of congress, they almost always hear the appeal.

to defend the obama administration. >>wouldn't do it. this is opposite day. >> i actually think the president's, dare i say, i've been critical of hs his handling of the middle east and specifically the u.s. relationship with israel, i think he's handled this well. i completely reject this is commitly motivated or about american jewish vote or the election. there's one time he doesn't have to play to the american jewish community it's right now, and i think he recognizes that israel was unprovoked, that they are dealing with a government in gaza that the u.s. and the europeans all label a terrorist organization, 12 to 15,000 rockets sitting in gaza built up over years, israel's in the last few weeks been subjected to over a thousand of them, i think his assessments is, it's a really complicated issue. of course he's horrified by the deaths on both sides, but the idea that israel can't respond the way it's responding, is completely unreasonable. and i think he is handling it well and that he's focused on egypt. egypt is -- morsi is the lynchpen here. if there's any stabilization

after the financial crisis in the early days of the obama administration. crucially for the sec, she took office right after the exposure of the bernie madoff scandal. and the sec has been struggling to put the pieces together ever since then. take a look at some of the highlights over at the sec. the sec pointing out this morning that they've had more enforcement actions than ever before in the past two years. 735 actions in 2011 and 734 in 2012. and the sec is now engaged in one of the busiest rule-making periods in decades and pointing out that her response to the frash crash included requiring exchanges to create a consolidated audit trail. this is a pretty well rolled out announcement here today. we saw the leak to the "new york times," then the official announcement and then a few minutes ago, the sec put out an e-mail entitled some of the accomplishments under mary shapiro's tenure. also going to hear from a lot of the critics of the sec. some on the left saying she has not gone far enough. the sec has not gone far enough and some on the right saying that dodd/frank and the re
